ClixBoom is operated by ClixBoom, s. r. o., a duly registered company, Company ID No.: 01482246, with its registered office at Prague, Old Town, Smetanovo nabrezi 327/14, ZIP code 110 00, Czech Republic, which is prepared to act, in relation to both users and advertisers, in a trustworthy and open manner.
These Terms of Use & Privacy Policy (hereinafter referred to as the Terms) are applied to you automatically when you become a user or advertiser in ClixBoom. By registering with ClixBoom, the user or advertiser confirms that he/she has read, understands, and accepts the Terms. If the user or advertiser does not accept the Terms, he/she may not register with ClixBoom.
1. Basic information
1.1 By registering, you gain access to ClixBoom, including all components, with the exception of the private area for administrators or support staff.
1.2 After registration and login, you may use the available services without restriction.
1.3 User can post messages on the forum soon after 5 days from the date of registration, personal messages to other users can send soon after 10 days from the date of registration. The user also must achieve a minimum of 100 credited clicks before sending the first post on the forum and 200 credited clicks before sending the first personal message. After these two basic limits, the ability to send personal messages and posts on the forum is available permanently.
1.4 You must respect other users and observe basic rules of etiquette. If these rules are not accepted, your account will be penalized.
1.5 You have the right to express yourself freely, but this must not result in harassment of any ClixBoom users or violation of any ClixBoom users’ rights.
1.6 Any kinds of publicity used by the user to obtain referrals, or to offer other financial transactions (exchange, trade, replacement) or other non-standard services, by posting comments on the forum or sending messages, are prohibited, both on the forum and in messages.
1.7 The following activities are also prohibited: creating nonsense posts, sending nonsense messages, duplicating topics, publishing illegal content, and sharing email addresses, social website links and instant messenger IDs.
1.8 Any accusation, intimidation, threats and disrespect towards ClixBoom or towards ClixBoom administrators directly on the ClixBoom website or anywhere else will be seen as disrespectful and may lead to penalties. In extreme cases, we will use the possibility to defend the good reputation of our company by all lawful means.
1.9 Creating posts or sending messages that may directly or indirectly harm ClixBoom, ClixBoom users, sponsors or service providers is strictly prohibited, and such posts or messages will be handed over to prosecuting authorities.
1.10 It is prohibited to impersonate, imitate or attempt to imitate a worker, administrator or host of the ClixBoom forum, especially when communicating with other users. It is also not allowed to use the ClixBoom logo (or imitations thereof) in forum posts, not even as an avatar.
2. User account
2.1 The user is obliged to create a secure password, not to disclose it and to keep it secret from others. Upon the user’s request, the password may be recovered automatically. This function is available after login.
2.2 It is permitted to have only one account per user. Similarly, a payment gateway account or bank account must be unique, and sharing is not allowed. In the event of violation of this section, all the relevant accounts will be penalized.
2.3 Multiple users’ access from the same IP address or computer is not allowed. ClixBoom uses control mechanisms to verify users’ IP addresses / computers and compares them, at regular intervals, with the data stored in the database. In the event of violation of this section, all the relevant accounts will be penalized.
2.4 Neither any email address provided by the user nor any other personal information may be disclosed, handed over to another person/entity or sold by ClixBoom.
2.5 Transferring accounts to other users is not possible.
2.6 ClixBoom administrators provide no (free or paid) user account customization.
2.7 Any user who deliberately enters false information when registering will be penalized.
2.8 Any disproportionately high number of requests to reload (refresh) individual ClixBoom pages by one user is prohibited and will be penalized.
3. Service availability and system support/protection
3.1 ClixBoom is available 24 hours a day, 365 days a year, with the exception of regular preventive checks and shutdowns.
3.2 ClixBoom runs on separate servers and is protected by a firewall and IPS.
3.3 ClixBoom administrators are entitled to shut down the service for the time necessary to update the system. Users will be informed of these shutdowns in advance on the ClixBoom website, except in cases of force majeure.
3.4 Service availability for specific IP addresses may be restricted or terminated in order to protect the service operation and other users.
3.5 Service support is only provided in English and Czech, with a guaranteed response time within 48 hours.
3.6 Any attempt to hack into the system is logged.
3.7 In most cases, the user receives a warning. If the user attempts to hack into the ClixBoom security system, his/her account will be terminated immediately.
3.8 If the user requests payout, our monitoring system will always carefully analyze this request. If the request is assessed as non-standard, the user’s account will be immediately suspended and subsequently terminated.
3.9 Information about account suspension or termination due to an attempt to hack into the ClixBoom system, or an attempt to influence payment gateways, is sent to the user at ClixBoom administrators’ discretion.
3.10 Transfer of important information is protected using HTTPS (SSL certificate).
4. Referrals
4.1 Referrals are ClixBoom users referred to ClixBoom by other users.
4.2 ClixBoom also allows renting referrals to other users.
4.3 Each user may refer any number of users to ClixBoom. However, the maximum amount of direct referrals who are tied to a specific user account is restricted by the type of membership.
4.4 There are two types of referrals in ClixBoom: direct referrals and rented referrals.
4.5 Each referral must be a user with a unique email address.
4.6 A referral may never change the user who referred him/her.
4.7 ClixBoom does not allow users to purchase direct referrals. Rented referrals may be rented by the user, but not purchased.
4.8 Rented referrals do not have an automatic return policy. Rented referrals are distributed based on an activity rule, but we cannot predict or assure how they will behave afterwards. If the rental expires, the referral is removed free of charge. We charge a fee of $0.05–0.08, depending on the type of membership, for replacing a referral during the rental.
4.9 You only receive commissions from direct referrals’ activity if the direct referral is linked directly to your account (the referral is obtained by using a link/banner and registered under a particular user).
4.10 A ClixBoom user may only rent rented referrals if they are available, in a number depending on his/her current type of membership. The system does not allow renting a higher number of rented referrals than permitted by the type of membership.
4.11 Profits from referrals’ clicks are credited instantly. The only advertisements that will be credited are Standard, Macro and Extended advertisements (in case of better types of memberships Fixed and Micro ads, too). With respect to these types of advertisements, a pro-rata amount is calculated for credited clicks of direct or rented referrals. The pro-rata amount is calculated based on a specific percentage point corresponding to your current type of membership and multiplied by the advertisement price. Example: if a referral receives $0.03 for viewing an advertisement, and you are currently a Plus member (30%), you receive $0.009 from the referral’s click. If you are a Silver member (50%), you receive $0.015, and if you are a Gold member (75%), you receive $0.0225.
4.12 Any user who owns direct or rented referrals must click at least 12 advertisements daily in order to receive profits from clicks of his/her direct and rented referrals the following day. The user is guaranteed to view at least twelve advertisements (Fixed Ads) every day. Advertisements are always reset at 00:00 of the server time.
5. User payout
5.1 All payments are made through PayPal, Payza and EgoPay payment gateways. Other automated payment methods are currently not supported.
5.2 Users possessing a bank account at any standard banking institution in the Czech Republic may also use this bank account for payout.
5.3 Payouts to bank accounts in the Czech Republic are made in CZK. Conversion from USD to CZK is carried out according to the current exchange rate valid on the date of transfer. Conversion is based on this exchange rate.
5.4 The charge associated with the payment transfer is debited to the recipient’s account. The charges are based on the price list of the selected payment gateway or bank.
5.5 All payments are made within 48 hours of request and are checked by our automated security system.
5.6 Payments to users with some types of membership are made instantly.
5.7 The minimum payout is $2 (first payout) and $5 (second payout); the minimum amount in other payouts is $5.
5.8 The condition of the first user payout is at least 150 credited clicks in ClixBoom. In any case, this minimum can be achieved in a maximum of 15 consecutive days of using ClixBoom.
5.9 The user may only request one payment at any one time. After the request has been handled, the user may not request additional payment earlier than in 5 or 7 days, depending on the type of membership.
5.10 ClixBoom is only responsible for sending payments. After the payment is transferred to the selected payment gateway (or bank), any problems must be dealt with by the support staff of this particular payment gateway (or bank).
5.11 The user is obliged to give correct, valid and existing information concerning his/her payment processor (PayPal, Payza, EgoPay) or his/her bank account. All payments are transferred to the payment gateway or bank account specified by the user and may not be subsequently cancelled. If you use PayPal, Payza or EgoPay, make sure that the payment gateway enables payment receipt in your country.
5.12 The ClixBoom provider will ignore any requests for compensation of erroneously sent payments.
6. Advertising
6.1 You can advertise any services, products, goods, projects and other activities within ClixBoom, except pages containing page-breaks, malicious code(s), conditional forwarding to other pages, pornography, illegal content, or pages supporting terrorism or sectarian activities.
6.2 Advertised links and subsequently displayed pages must be fully displayed within 10 seconds from the moment of display start.
6.3 ClixBoom administrators reserve the right to prohibit any advertisement which they consider objectionable.
7. Payments to ClixBoom
7.1 All payments to ClixBoom may only be made through the “My Account” menu, by clicking “Add Money”. Other payment methods are not accepted.
7.2 Payments to ClixBoom are not refundable.
7.3 ClixBoom only accepts payments from verified accounts with PayPal, Payza and EgoPay payment gateways.
7.4 All chargebacks or reversed transactions made on your payments will be considered a gross violation of the ClixBoom Terms of Use and will lead to an immediate account suspension.
8. User account termination/suspension
8.1 ClixBoom administrators are entitled to temporarily suspend or terminate your account for any serious reason, especially due to a breach of these Terms.
8.2 Suspended accounts will have all their balances reset, all referrals taken away, and no refunds will be given.
8.3 All terminated accounts will be archived, and the user may not register with ClixBoom using the same username or email addresses.
8.4 After 60 days of inactivity, the user account will be automatically terminated without refund.
9. Contests, PTSU offers and Video
9.1 ClixBoom service allows users to participate in contests on the ClixBoom website, passively or actively.
9.2 Users can passively participate in “Points Contest” and “Referral Contest”.
9.3 Users can actively participate in “Heads or Tails” and “Boom Grid”.
9.4 Passive contests are based on the principle of a time-limited competition where users can influence their position in the contest by completing tasks inside ClixBoom (by clicking on an advertisement, posting a comment on the forum or obtaining a direct referral). Prizes in these contests are always credited afterwards. The user is involved in this contest automatically, just by using ClixBoom.
9.5 Active contests are not time limited. The user can actively enter the contest, and participation in these contests is completely at the discretion of the user. Prizes in these contests are credited instantly.
9.6 PTSU offers (hereinafter referred to as incentives) are advertisers’ incentives that require any user who accepts the advertiser’s offer to perform a further action, mostly outside ClixBoom. After completing the incentive task, the user is rewarded according to pre-determined criteria.
9.8 The incentive advertiser must adjust the conditions so that they can be met within 4 days from the date the user accepts the advertiser’s incentive.
9.9 The PTSU advertiser verifies whether the user has completed the incentive task, and if so, the user will be rewarded by the advertiser in the amount set beforehand. The transaction between the user and the advertiser is mediated by ClixBoom automatically after the advertiser confirms the user as successful. If the advertiser does not confirm this in four days, all unconfirmed users will be considered as successful regarding the incentive conditions, and the set amount will be credited automatically.
9.10 ClixBoom monitors rating of users by advertisers and checks the use of incentives by users. If users access advertisers’ incentives irresponsibly, fail to complete advertisers’ tasks, and only use incentives for unjust enrichment, their access to the incentives will be disabled.
9.11 ClixBoom checks and monitors the distribution and verification of rewards from advertisers. If an advertiser intentionally marks a user as unsuccessful, unless justified, the advertiser’s account will be penalized, and the user will be credited the reward.
9.12 Any disputes between users and advertisers regarding incentives will always be settled by the ClixBoom administrator, and the administrator’s decisions will be final. The decisions may not be appealed, and no compensation will be provided.
9.13 Contests organized by ClixBoom are in accordance with game concepts that are not regulated by Act No. 202/1990 Coll., on lotteries and other similar games, as amended, particularly because no bet is required for participation in these contests or because they are consumer, marketing, knowledge, creativity, speed and performance based contests, contests with pre-determined standings, or contests based on the “everybody wins” concept.
9.14 Videos are provided by our partner Virool company. The availability of content is dependent on several aspects and actual video content is refreshed several times per day. Profits for video display are credited to the user immediately after watching the video. Service ClixBoom is not and cannot be responsible for distribution of video content. Any disputes relating to the problems connected with crediting profits to the user for displayed video are solved according to Terms of Use of video provider and the user is required to resolve the dispute directly with the provider of video content.
10. Liability
10.1 ClixBoom is not liable for any delays or failures that are not directly related to ClixBoom, and therefore beyond our control.
10.2 ClixBoom reserves the right to alter the Terms at any time, including fees and special or other offers.
10.3 ClixBoom will not be held responsible for its users, advertisers and advertisements. Likewise, ClixBoom will not be held responsible for service suppliers.
10.4 ClixBoom is not responsible for any additional charges of individual payment gateways and banks. It is your responsibility to declare and pay taxes on payments received in your country.
11. Privacy policy
11.1 Your browser must accept cookies.
11.2 ClixBoom guarantees that cookies are only used to store your settings.
11.3 Your personal email address will only be used by ClixBoom to communicate with you. Likewise, your e-wallet addresses and bank account numbers will only be used by ClixBoom to send payments or identify your purchase/deposit.
11.4 Your password is stored in an encrypted format and cannot be decrypted.
11.5 Your user password will never be shown, sold or given to third parties.
11.6 Your username will be kept hidden by default from other users. This username will only be displayed to a referral (or a potential referral) to whom you send your registration link in order to assign him/her under your account as a direct referral.
11.7 Your username will only be displayed on the forum if you reply to a post or create your own topic.
11.8 ClixBoom will not be held responsible for the content of advertisements, which applies to all advertisements that may be displayed within ClixBoom.
11.9 The responsibility for clicking on any advertisement content displayed by ClixBoom, browsing the content of the website, and performing other actions based on advertisements lies solely with the user.
11.10 The responsibility for all displayed advertisements lies with the advertiser, and these advertisements must be in accordance with the Terms of Use & Privacy Policy.
